Covid-19 Update from Mayor and Emergency Order 20-03

Mayor Breckenridge provides regular updates on the COVID-19 situation in Cameron. New Order 20-03 issued today to begin the recovery process.

**CURRENT UPDATE**  (4/30/2020)

To: The Residents of the City of Cameron

As anticipated, the City of Cameron is issuing a new Order today which will be effective on Monday, May 4th at 12:01 am.  This Order, 20-03, sets the guidelines as we move forward and begin the process of recovery from the COVID-19 pandemic.  Everyone is still urged to stay home if you are ill and practice social distancing guidelines when you do leave your home.  Please see the attached Order(s) for full details of the new guidelines.

In addition to the City’s Order, the State Department of Health and Senior Services issued a new order on April 27th and the Clinton County Health Department issued a new order today as well.  Both these orders apply to Cameron residents and are attached as exhibits to the City’s Order 20-03.  

The Parks and Trails are open, however, the shelters, restrooms, basketball courts and volleyball courts will remain closed until further notice.  The Park Board will be discussing the anticipated opening of the swimming pool and will relay that information as soon as a decision is reached.

In the meantime, keep up the good work!  Our area’s low COVID-19 cases are a testament to the diligence our citizens have made in their social distancing habits.

EMERGENCY ORDER 20-03

WHEREAS, on April 6, 2020, the City Council of the City of Cameron, Missouri adopted Ordinance No. 6133, which, among other things, required individuals and businesses to take certain actions to mitigate the spread of COVID-19, including the requirement that individuals, businesses, and retail entities practice social distancing; and 

WHEREAS, the Ordinance additionally authorized the Mayor to issue and promulgate certain administrative orders and regulations in addition to those set forth in the Ordinance to protect the public health and safety of the citizens of the City of Cameron, Missouri; and

WHEREAS, on April 27, 2020, the Director of the Department of Health and Senior Services, finding it necessary to protect the public health and prevent the further spread of COVID-19, issued a certain order (“DHSS Order”) that, in part, required every person and business to adhere to social distancing guidelines from the President and the Centers of Disease Control and Prevention and authorized business to continue or resume operation as the case may be subject to certain restrictions; and

WHEREAS, on April 30, 2020 the Clinton County Missouri Health Department Administrator issued Order 20-02 which addressed ongoing social distancing guidelines for individuals, businesses and group functions; and

WHEREAS, the COVID-19 virus spreads between people who are in close contact with one another through respiratory droplets produced when an infected person coughs or sneezes; and
 
WHEREAS, a gathering of individuals without necessary mitigation for the spread of infection may pose a risk of the spread of infectious disease; and

WHEREAS, the City wishes to employ all means available under the law to protect public life, health, safety and property to limit the development, contraction and spread of COVID-19 creating this emergency; and

WHEREAS, the Ordinance, the Code of the City, and applicable Missouri law authorize the Mayor and City Council of the City to take all necessary action to protect Cameron residents. 

NOW, THEREFORE, IT IS SO ORDERED BY THE MAYOR OF THE CITY OF CAMERON, MISSOURI, AS FOLLOWS: 

Order 20-01 dated April 7, 2020 and Order 20-02 dated April 9, 2020, are hereby repealed and the following Order 20-03 is enacted in lieu thereof, to read as follows:

Section 1.  The order of the Director of the Department of Health and Senior Services (DHSS) issued on April 27, 2020 attached hereto as Exhibit A and incorporated herein by reference, is hereby adopted and shall be in full force and effect within the City of Cameron, Missouri while this Order is in effect.

Section 2.  The order of the Administrator of the Clinton County Health Department issued April 29, 2020 attached hereto as Exhibit B and incorporated herein by reference, is hereby adopted and shall be in full force and effect within the City of Cameron, Missouri while this Order is in effect.

Section 3.  Social Distancing.  In accordance with the guidelines from the President of the United States and the Center for Disease Control and Prevention (CDC), every person and business in the City shall abide by social distancing requirements, including maintaining six feet (6’) of space between individuals.  This directive shall apply in all situations, including but not limited to, when customers are standing in line or individuals are using shared indoor or outdoor spaces when outside their residence.  All businesses shall post a notice on all entrances or exits to the business directing individuals entering the business to practice social distancing.

Section 4. Precautionary Measures. Businesses that were directed to cease operations due to social distancing conflicts in Order 20-01 will be allowed to resume operations if those businesses comply with the precautionary measures and guidelines.  Businesses closed pursuant to Order 20-01 included but were not limited to barber shops, hair salons, nail salons, massage parlors, fitness centers and gyms. Precautionary measures to be implemented are as follows:
 
A. Barbershops, nail salons, spas:
    1. Barbers, beauticians, technicians, etc. shall wear masks when unable to maintain the six foot (6’) social distance requirement.  Gloves should be worn when appropriate.
    2. Workstations, equipment, chairs, etc. must be disinfected in between each client.
    3. Clients in waiting areas must maintain the six foot (6’) social distancing requirement.
B. Gyms, fitness centers:
    1. Staff shall disinfect equipment, machines, mats, etc. after each use.
    2. Staff and patrons shall comply with social distancing with the exception of personal trainers/spotters. Staff &/or customers who cannot maintain the six foot (6’) social distancing requirement for safety or      instructional reasons shall wear masks.
C. Dine-in Restaurants.  Restaurants may offer dining-in services, provided that:
    1. The business shall provide proper spacing of at least six foot (6’) between tables.
    2. No communal seating areas (bar seating/community tables) or tables/parties of more than ten (10) patrons shall be allowed.
    3. Seating areas to include tables, seats, menus, and table condiments shall be disinfected between patrons.
    4. The continued use of drive-thru, pickup and delivery options is encouraged throughout the duration of the pandemic.

Section 5.  Businesses and Retail Entities. Any Business and retail entity that may conduct business in accordance with the social distancing guideline shall limit the number of individuals in any particular location as follows:

A. Twenty-five percent (25%) or less of the entity’s authorized fire or building code occupancy, as determined by the city’s Community Development Director or Fire Chief for a retail location with square footage of less than ten thousand square feet (10,000 ft2).
B. Ten percent (10%) or less of the business or entity’s authorized fire or building code occupancy as determined by the City’s Community Development Director or Fire Chief for a retail location with ten thousand square feet (10,000 ft2) or more.
C. Physical Barriers between Employees and Customers/Patrons.  All businesses shall provide a physical barrier between employees and customers or patrons at common places of interaction/contact/sales between the same.  This physical barrier requirement may be met by requiring employees to wear adequate personal protection equipment, building of a plexiglass partition at points of interaction/contact/sale or placing boxes, tables or other obstructions between employees and customers at points of interaction.

Section 6. Interpretation. Nothing in this Order shall be interpreted or construed as being inconsistent with the April 27, 2020 Order of the Director of Health and Senior Services, the April 29, 2020 Order of the Administrator of the Clinton County Health Department or other superseding ordinance, order, regulation or law. If any conflict is identified among these orders, the most restrictive order shall apply. If a court of competent jurisdiction determines that any term or provision of this Order is invalid, illegal, or unenforceable, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Order. 

Section 7. Violation of any provision of this Order constitutes an imminent threat, creates an immediate menace to public health, and shall be considered a violation of the Code of the City of Cameron, Missouri. Specifically, if any business fails to adhere to of the requirements of this Order or the Ordinance said failure shall be considered a violation of Section 6-20 of the Code of the City of Cameron, Missouri.  

Section 8. This Order is in full effect and force from 12:01 A.M. May 4, 2020 until it is rescinded, superseded, preempted or amended in writing.

DEPARTMENT OF HEALTH AND SENIOR SERVICES (DHSS) 04/27/20 ORDER

    The Director of the Department of Health and Senior Services, finding it necessary to protect public health and prevent the further spread of COVID-19, pursuant to the authority granted under section 192.020, RSMo, and 19 CSR 20-20.040, hereby order the following:
1. When individuals leave their homes or places of residence to work, to access food, health care, necessities, or to engage in other activities, they should at all times practice social distancing. Individuals may go to and from an individual’s place of worship, provided that limitations on social distancing are properly adhered to.
2. In accordance with the guidelines from the President and the Centers for Disease Control and Prevention (CDC), every person and business in the State of Missouri shall abide by social distancing requirements, including maintaining six feet (6’) of space between individuals. This provision shall not apply to family members or individuals performing job duties that require contact with other people closer than six feet (6’). Individuals performing job duties that require contact with other people closer than six feet (6’) should take enhanced precautionary measures to mitigate the risks of contracting or spreading COVID-19. This provision shall apply in all situations, including, but not limited to, when customers are standing in line or individuals are using shared indoor or outdoor spaces.
3. In accordance with the guidelines from the President, the CDC, and the Centers for Medicaid and Medicare Services, people shall not visit nursing homes, long-term care facilities, retirement homes, or assisted living homes unless to provide critical assistance or in end-of-life circumstances. Elderly or otherwise vulnerable populations should take enhanced precautionary measures to mitigate the risks of contracting COVID-19.
4. Any entity that employs individuals that is engaged in retail sales to the public, shall limit the number of individuals in any particular retail location as follows:
   (1) Twenty-five (25) percent or less of the entity’s authorized fire or building code occupancy, as set by local authorities, for a retail location with square footage of less than ten thousand square feet (10,000 ft²);
   (2) Ten (10) percent or less of the entity’s authorized fire or building code occupancy, as set by local authorities, for a retail location with square footage of ten thousand square feet (10,000 ft²) or more.
5. In accordance with the guidelines from the President and the CDC, schools shall remain closed for the remainder of the 2019-2020 academic school year. At the discretion of the school district, nothing in this Order shall prohibit school teachers, school staff, students, and parents from reentering school buildings in order to work, retrieve personal belongings, or return school property as long as limitations on social distancing are properly adhered to. Summer school may proceed under guidelines set forth by the Department of Elementary and Secondary Education. Notwithstanding section 2 of this Order, nothing in this Order shall prohibit daycares, child care providers, or schools from providing child care in accordance with CDC guidelines. Further, this Order does not prohibit schools from providing Food and Nutritional Services for those children that qualify.
6. Restaurants may offer dining-in services, provided that the limitations on social distancing and other precautionary public health measures, including proper spacing of at least six feet (6’) between tables, lack of communal seating areas to parties that are not connected, and having no more than ten (10) people at a single table, are properly adhered to. The continued use of drive-thru, pickup, or delivery options is encouraged throughout the duration of this Order.
7. State office buildings shall be open to the public as soon as practicable, and essential state functions shall continue. The State Capitol Building shall remain open to the public during meetings or proceedings of the General Assembly.
8. Pursuant to section 44.101, RSMo, this Order shall not be construed to prohibit or restrict the lawful possession, transfer, sale, transportation, storage, display, or use of firearms or ammunition during the declared state of emergency, subject to the provisions set forth herein.
   Pursuant to section 192.290, RSMo, this Order shall be observed throughout the state and enforced by all local and state health authorities; provided however, nothing herein shall limit the right of local authorities to make such further ordinances, rules, regulations, and orders not inconsistent with this Order which may be necessary for the particular locality under the jurisdiction of such local authorities. Local public health authorities are hereby directed to carry out and enforce the provisions of this Order by any legal means.
   This Order shall be in effect beginning 12:01 A.M., Monday, May 4, 2020, and shall remain in effect until 11:59 P.M., Sunday, May 31, 2020, unless extended by further order of the Director of the Department of Health and Senior Services with said extensions not to exceed the duration of the effective period of Executive Order 20-09.

CLINTON COUNTY HEALTH DEPARTMENT ORDER 20-02

WHEREAS, the existence and spread of the COVID -19 virus has resulted in the declaration of a worldwide pandemic, and it is necessary and appropriate to continue protective action to reduce the possibility of exposure to COVID-19 and to reduce the spread of COVID-19; and
WHEREAS, the COVID-19 virus spreads between people who are in close contact with one another through respiratory droplets produced when an infected person coughs or sneezes; and WHEREAS, a gathering of individuals without necessary mitigation for the spread of infection may pose a risk of the spread of infectious disease; and
WHEREAS, the County wishes to employ all means available under the law to protect public life, health, safety and property to limit the development, contraction and spread of COVID-19 creating this emergency;
WHEREAS, as of April 30th, 2020 new cases of COVID-19 have shown a significant decrease, and available testing for acute illness has grown to an acceptable level to warrant loosening restrictions in the prior Emergency Order issued by the Clinton County Health Department; and
WHEREAS, I, Blair E Shock, Administrator of Public Health for the Clinton County Health Department and Health Officer for the County of Clinton do find the aforementioned conditions constitute a threat to the health, safety and welfare of the residents of Clinton County, and creates a public health emergency situation within the meaning of Chapter 192 of the Revised Statutes of Missouri and Title 19 Division 20, Chapter 20 of the MO Code of State Regulations;
NOW, THEREFORE, under the power vested in me under appropriate local, state and federal regulations and other enabling provisions, I, Blair E. Shock, Administrator of Public Health for the Clinton County Health Department and Health Officer for the County of Clinton do hereby order the following:
All Persons shall:
1. Remain home if sick or ill, except to seek medical treatment from a licensed medical provider.
2. Implement personal protective measures, such as staying home when sick, frequent handwashing, and routine cleaning of surfaces.
3. Engage in social distancing by taking responsible efforts to be separated from other individuals by at least six (6) feet.
4. Persons at high risk due to pre-existing conditions or advanced age are advised to remain sheltered at home as much a practical, and should avoid group gatherings.

All Businesses shall:
1. Limit the number or persons in any particular location as follows:
   1. 25% or less of the entity’s authorized fire or building code occupancy for businesses with square footage less than 10,000ft2
   2. 10% or less of the entity’s authorized fire or building code occupancy for businesses with square footage of 10,000ft2 or more.
   3. Base occupancy shall be calculated by municipal code, if applicable, or at the rate of 1 person per 30ft2 if located in a municipality who’s code does not define occupancy load, or for any business located within an unincorporated area of Clinton County.
2. Maintain a distance of at least six feet between all persons if able.
3. Provide alternative protective measures, including but not limited to coverings for the nose and mouth for employees whose regular job duties require them to work closer than six feet from other employees or customers.
4. Continue to permit all employees who are capable to work from their residence or regular place of abode.
5. Require ill employees to exclude themselves from work while sick or ill until such time as employee’s symptoms have resolved or they have been cleared to return to work from a licensed healthcare provider.
6. Provide for regular cleaning, disinfection, and other mitigation of risk
Violation of this order constitutes an imminent threat to public health and shall be in violation of RSMo 192.300(4)
This order shall begin at 12:01AM on Monday, May 4th, 2020 and shall be remain in effect until 11:59PM on Sunday, May 31, 2020 unless earlier amended or revoked by the County Health Officer of Clinton County.

Interim Guidance on Group Gatherings
Items below are intended to provide guidance for those who are organizing or attending any social, religious, or business group gathering. They do not are not part of the order above, but should be used to clarify personal and business requirements related to group gatherings.

All persons are strongly encouraged to limit attendance at large group gatherings, and limit attendance at large group gatherings to 25 or fewer persons.

Church gatherings are permitted so long as they comply with individual distancing requirements as well as reduced occupancy limits as defined for businesses within this order. Churches are strongly encouraged to continue to provide alternative means of electronic attendance for members even as in-person meetings resume.

Persons at high risk due to pre-existing conditions or advanced age are advised to remain sheltered at home as much a practical, and should avoid group gatherings.

All applicable business and personal requirements of Public Health Order 20-02 remain applicable for group gatherings.
